PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS SITE
By using this site, you signify your assent to
these terms of use. If you do not agree to these terms of use, please do
not use this site. These terms of use may be amended at any time. Your
continued use of this Web site is conditioned on the terms of use stated
at the time of your use. You should visit this page prior to using this
Web site to determine the current terms of use to which you are bound.
RESTRICTIONS ON USE OF
MATERIALS
This site is owned and operated by the Alberta
Alcohol and Drug Abuse Commission (referred to as "AADAC,"
"we," "us," or "our" herein) and contains
material which is derived in whole or in part from materials supplied by
AADAC and other sources and is protected by copyright, trademark and other
intellectual property laws. AADAC, its graphical presentation and related
logos are the property of AADAC. All rights reserved. All other trademarks
and logos are the property of their respective owners. You may not modify,
copy, reproduce, republish, upload, post, transmit or distribute in any
way any material from AADAC4KIDS.com, or any other Web site owned,
operated, licensed or controlled by AADAC including, without limitation,
code and software (collectively, the "Material"). Use of the
Material for any such purpose, including the use of any such materials on
any other Web site or networked computer environment, is a violation of
AADAC's copyright and other proprietary rights and is expressly
prohibited. Notwithstanding the foregoing, you may download Material from
this site for your personal, non-commercial use only, provided you keep
intact all copyright, trademark and other proprietary notices.
CONTENT APPROPRIATENESS
AADAC's youth-oriented Web site, AADAC4KIDS.com,
has been created to lead children to information and activities that AADAC
believes to be accurate, sound, and appropriate for youth. However, AADAC
makes no representation or guarantee with respect to the materials
appearing on its site or any other site linked thereto. AADAC believes
that the best way to protect your children online is to openly discuss the
rewards and risks of using the Internet. AADAC recommends, however, that
you use parental-control software (i.e., Cyber Patrol, Cybersitter,
Internet in a Box for Kids, Net Nanny or Surf Watch) if you desire to be
more cautious or would like additional assistance in introducing your
child to the Internet. For additional information about parental-control
software, visit: http://www.w3.org/pub/WWW/PICS/.
However, AADAC makes no representations with respect to the material
appearing on such site.
LICENSE TO AADAC
AADAC is pleased to hear from its loyal fans and
welcomes your comments regarding AADAC products, including AADAC's online
services. Unfortunately, however, AADAC's long-standing policy does not
allow it to accept or consider creative ideas, suggestions or materials
other than those it has specifically requested. We hope you will
understand that it is the intent of this policy to avoid the possibility
of future misunderstandings when projects developed by AADAC's
professional staff might seem to others to be similar to their own
creative work. Accordingly, we must, regretfully, ask that you do not send
us any original creative materials such as stories or character ideas,
screenplays, or original artwork, other than those that we might
specifically request from time to time.
By posting messages, uploading files, inputting
data, or engaging in any other form of communication (a
"Communication") through this service, you are granting AADAC a
royalty-free, perpetual, non-exclusive, unrestricted, worldwide license
to:
- Use, copy, sublicense, adapt, transmit, publicly
perform or display any such Communication; and
- Sublicense to third parties the unrestricted
right to exercise any of the foregoing rights granted with respect to
the Communication.
The foregoing grants shall include the right to
exploit any proprietary rights in such Communication, including but not
limited to rights under copyright, trademark, servicemark, or patent laws
under any relevant jurisdiction.

BULLETIN BOARDS
This service may include bulletin boards and
chat rooms ("Bulletin Boards") which allow feedback to AADAC and
real-time interaction between users. AADAC will monitor all messages,
information, and files delivered to Bulletin Boards, and reserves the
right to edit for brevity and exclude posts and messages that are deemed,
in AADAC's sole discretion, as inappropriate. It is a condition of your

You understand that AADAC will monitor the Bulletin
Boards to the extent described above. However, AADAC reserves the right at
all times to disclose any information as necessary to satisfy any law,
regulation or governmental request, or to edit, refuse to post or to
remove any information or materials, in whole or in part, that in AADAC’s
sole discretion are objectionable, in violation of these Terms and
Conditions, or for any other reason.
LINKS SECTION DISCLAIMER
Without in any way limiting the General
Disclaimer set forth above, the World Wide Web changes constantly and, as
a result, AADAC cannot and does not guarantee that the links associated
with the sites included in the Links section will be accurate at the time
of your search. Moreover, the sites included in the Links section are
developed by persons over whom AADAC exercises no control. Accordingly,
AADAC assumes no responsibility for the content of any site included in
the Links section.
AADAC may occasionally receive requests from
representatives of sites included in the Links section to remove links to
their sites from the Links section. Although AADAC reserves the right to
address such requests individually, the general approach that AADAC takes
reflects the following principle:
- In general, AADAC believes that persons who make
information available on the World Wide Web do so with the expectation
that such information will be publicly and widely available. AADAC
further believes that its making links and/or access to publicly
accessible webpages available at this site is legally permissible and
consistent with the common, customary expectations of those who make
use of the Web communications media.
LIMITATION OF LIABILITY
Under no circumstances, including, but not
limited to, negligence, shall AADAC, its subsidiaries or affiliates be
liable for any direct, indirect, incidental, special or consequential
damages that result from the use of, or the inability to use, the
materials in this site, even if AADAC or an AADAC-authorized
representative has been advised of the possibility of such damages. You
specifically acknowledge and agree that AADAC is not liable for any
defamatory, offensive or illegal conduct of any user of the site. If you
are dissatisfied with any AADAC material, or with any of the terms and
conditions contained herein, your sole and exclusive remedy is to
discontinue using the site. Without in any way limiting the foregoing, in
no event shall AADAC's total liability to you for all damages, losses, and
causes of action (whether in contract, tort (including, but not limited
to, negligence) or otherwise) exceed $25.
TERMINATION
This agreement is effective until terminated by
AADAC, at any time without notice. In the event of termination, you are no
longer authorized to access the Bulletin Boards and the restrictions
imposed on you with respect to material downloaded from the Bulletin
Boards, the disclaimers and limitations of liabilities set forth in this
agreement, shall survive.
OTHER
This agreement shall be governed by and
construed in accordance with the laws of the Province of Alberta without
giving effect to any principles of conflict of law. If any provision of
this agreement shall be unlawful, void, or for any reason unenforceable
then that provision shall be deemed severable from this agreement and
shall not affect the validity and enforceability of any remaining
provisions. You acknowledge that you are at least eighteen (18) years of
age.
